Terms of Service



The Sugar Mama Service (the “Service”) is wholly-owned by Virgin Mobile USA, LLC (“VMU”), based in Warren, New Jersey. The Service is administrated by Ultramercial LLC (“UML”), based in Palos Verdes Estates, California.  Some items outlined in these Terms & Conditions are handled jointly by both entities. When “we” is used within this document, this word refers to both entities jointly. Within these Terms and Conditions, VMU Airtime Minutes may be referred to as “minutes.”

These Terms & Conditions define your use of the Sugar Mama Service. By logging into the Sugar Mama Service, you accept these Terms & Conditions:

As long as you are a VMU wireless customer, the Sugar Mama Service offers you the opportunity to engage with our partners, and upon completing the required steps within the partners’ commercials and answering all questions at the conclusion, you will be rewarded with VMU airtime minutes, posted to your VMU account.  We also will offer you additional offers, such as text message-based commercials and other partner-based communications, which may be completed by you in order to receive additional VMU airtime minutes.

The maximum VMU airtime minutes that you may accrue within one calendar month is 75, consisting of: (1) a maximum of 60 VMU airtime minutes upon your completion of full-screen browser-based commercials or online surveys; and (2) a maximum of 15 VMU airtime minutes by engaging and completing surveys and/or questionnaires through text message-based communications, delivered to your VMU wireless number that is linked to your Sugar Mama login.

Additionally, you may be limited to the number of VMU airtime minutes that can be accrued during a single visit. You may return after a specified time to begin a new visit to accrue additional VMU airtime minutes.

User Requirements for Participation
The Service requires you to:

  1. Connect to the Service through a computer that is running Windows 2000 or higher, or Macintosh OS 10.x or higher; and use the current version of one of these browsers: Internet Explorer, Firefox, Netscape.  Other operating systems and browsers may not be compatible, but are not excluded.
  2. Accept all cookies set by VMU, the Service and Ultramercial LLC. If you need help in how to set your browser to accept these specific cookies, or to learn about what cookies are, please see the Frequently Asked Questions section of the Service.  Your default browser settings will automatically accept all necessary cookies.
  3. Have a continuous Internet connection during the sequence of events that include logging in, starting a commercial, completing all steps within the commercial, answering any questions at the conclusion of the commercial, and clicking to see the confirmation page that verifies that your account has been credited with a VMU airtime minute(s).  Interruptions in connectivity to the Service and the cache.ultramercial.com domain during this sequence may cause you to not receive the VMU airtime minute(s).  A broadband connection is highly recommended but not required.  A poor wireless connection may prevent continuous Internet connectivity.
  4. Have graphics turned on within your browser. Graphics are normally on by default. Visually impaired users must have a browser reader capable of “speaking” alt tags associated with buttons and prompts and have “Sound” enabled.
  5. Accept our detection scripts that will identify your connection speed, operating system, browser type, and plug-in capabilities. Browsers accept these prompts in their default settings.
  6. Have the Flash Plug-in 6 or higher installed. Most newer computers come with Flash 6 or higher pre-installed. The Flash plug-in is free and is available at http://www.adobe.com.
  7. Accept Javascripts. Your browser accepts these by default.

 
Prohibited Activity
The Service prohibits the following behavior by its users:

  1. Any fraudulent attempt to receive VMU airtime minutes through the Service system and business model.
  2. Filing a false complaint or dispute for the purpose of receiving VMU airtime minutes.
  3. Any attempt to “hack” into computers running any part of the Service or the commercials associated with the Service.
  4. Any attempt to use computer code to fraudulently receive VMU airtime minutes.
  5. Except, and only to the extent necessary to display upon the user’s computer, you will not copy, print, display, publish, use, transmit, modify, create any derivative work from, or merge with or into any other software program, or decompile, reverse compile, reverse engineer, decode, disassemble or otherwise attempt to derive source code or process methods from any Service or associated ad units or any other component of the Service.

 
VMU Airtime Minutes received through the Sugar Mama Service

  1. VMU airtime minutes will be added to the available minutes of your VMU cell phone account.  Each minute will become available in real time at the point you receive the confirmation page at the Service. The minute does not expire as long as your account remains in good standing.
  2. Your total minutes accrued per Calendar month will be displayed at the Service.  Additionally, total minutes accrued since opting into the Service may also be displayed. The number of minutes displayed at the Service may not match the available airtime minutes on your VMU wireless account, based on your airtime usage. You will need to login to your VMU wireless account to see your current available airtime balance.

User Difficulties Using the Service
The Service will provide you with support in using the system and resolving any issues regarding VMU airtime minutes awarded through this system.

  1. We provide a “Help” link on our home page that provides frequently asked questions and a list of self-help suggestions for the most common problems.  We also offer a contact email address on the Help page to contact us directly.
  2. If you believe that you were not awarded an airtime minute after completing a commercial, you can email us for a resolution.  Should you find that you are not being credited the minutes, we ask that you discontinue use and contact us immediately.
  3. Dispute resolution regarding VMU airtime minutes shall not exceed the total number of minutes available within a specific time period, or the minutes available within a specific site visit.

THE SERVICE PROVIDES NO WARRANTIES IN REGARDS TO TECHNOLOGY’S USABILITY ON YOUR COMPUTER

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS AND CONDITIONS FOR USE, THE TECHNOLOGY AND BUSINESS MODEL, INCLUDING ANY SOFTWARE THEREIN, IS PROVIDED "AS IS" WITH NO EXPRESS, IMPLIED OR STATUTORY WARRANTIES, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF TITLE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR RESULT. NEITHER VMU NOR UML SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES (i) ARISING OUT OF THE USE OF THE TECHNOLOGY OR INABILITY TO USE THE TECHNOLOGY, OR OUT OF ANY BREACH OF ANY WARRANTY, OR (ii) FOR ANY DAMAGES RESULTING FROM LOSS OF USE, DATA OR REVENUES, WHETHER IN AN ACTION BASED ON CONTRACT, NEGLIGENCE OR OTHER TORTIOUS CONDUCT, OR STRICT LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE TECHNOLOGY.

Use of Your Customer Information
We will always handle your information in a manner consistent with federal customer privacy laws and the Sugar Mama Service Privacy Policy. We take all reasonable steps to protect your personal information from unauthorized use or disclosure. Except as contemplated by the Privacy Policy, we will not intentionally share your personal information without your permission.  Unless you opt out, we may, from time to time, use the information you provide us with to market services to you that may be related to our service offerings, but you will have the opportunity to choose whether you would not like to receive text messages, direct mail and other updates from the Sugar Mama Service and its partners about hot new products, special promotions, and important service information by editing your profile at www.virginmobileusa.com or by calling Virgin Mobile At Your Service at 1-888-322-1122.

Trademarks
The "Virgin" name and signature and the "Virgin Mobile" name and logo are registered trademarks of Virgin Enterprises Limited and used under license by Virgin Mobile USA, LLC. “Sugar Mama” is a service mark of Virgin Mobile USA, LLC. Ultramercial is the registered trademark of Ultramercial LLC.

Other

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any principles or conflicts of law. If any provision of these Terms & Conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
